Public Highway

 

Public Highway

The public highway encompasses pavements, footpaths, roads and bi-roads. When carrying out any building work, maintenance, or removing part of a property next to a public road, pavement or rear lane, the safety of people on the road is paramount. As such licenses are needed to ensure that the safety of the public is maintained If you want to carry out works on the public highway, or you want to put a skip, scaffolding, access plant, refreshment facilities or other objects on, in or over the public highway then, under the Highways (Jersey) Law 1956, permission is required from the Parish, in conjunction with the Highways Authority, if not the Parish.


Precinct Areas:

St Helier being the island’s capital has a number of high streets in the Town Centre that are restricted to pedestrians. There are occasions when vehicles are needed on these precincts, such as shop fitting, or a resident moving out of a property. The areas restricted to pedestrians are set out in this map.

Advertising Boards (P2):

Within the town centre, businesses and organisations want to get themselves noticed, and one method is via advertising boards. In order to avoid these boards cluttering up the streets boards must be licensed in order to be on the public highway.

Once granted, the licence runs through until 31st December of each year, after which period a new application will need to be submitted.

If granted it is important to display your licence label on the inside of the advertising board, to allow our Honorary Road Inspectors to identify those boards that are/are not licensed.

Displaying Goods (P5):

Displaying goods and using advertising signs on footways and pedestrian areas all add to the colour and atmosphere to every day life and can enhance the environment within which we live and work. However, they can also interfere with public passage along a pavement and cause a hazard particularly for disabled and visually impaired people.

As such an application form can be downloaded  and submitted using the details at the bottom of this page, for consideration.


Public Events:

St Helier proudly maintains a number of parks and open spaces throughout the parish, which can be used for public events. Ideally, we would like to know about your event as soon as possible as the more notice we have the more chance we have of being able to overcome any potential problems which may arise. As a general rule, we would normally require at least 4 weeks notice.

The cost of holding an event in St Helier varies depending on the duration and nature of the event. It is very easy to apply to stage your event; First of all, send us an email and briefly describe what it is you would like to do, where you would like to do it and when the event is to take place. We will then do a quick check to make sure that your proposed event does not clash with something else that is happening in the Parish at the same time and that the area you would like to hold your event is available.


Al Fresco Eating:

For information on placing tables and chairs on a public highway for al fresco dining, send us an email, briefly describing what it is you would like to do, including the shop name and address.


Construction work in St Helier (P4):

Site work – whether it is construction, development, demolition, big or small – if it has an impact on the public highway please contact our Streets Co-ordinator on the details at the bottom of the page to discuss further.

Noise in and around St Helier should work within the guidelines of the Statutory Nuisances (Jersey) Law 1999. Guidelines can be found on the following link (Note this is an external website, and out of the control of the Parish).
 
If works on the public highway are going to result in the loss of amenity space for use by the public, and application needs to be submitted. This can be downloaded and submitted using the details at the bottom of this page, for consideration.


Scaffold or Hoarding (P9):

You must provide safe areas at ground level or a platform at high levels. When it is necessary to place hoardings on the road/pavement around the place of work or scaffolding, you need to obtain permission from the Parish by completing a form together with a sketch. If you get permission, please read it carefully and make sure you adhere to all the conditions of the license.

As we licence, and invoice direct, the Contractor who places the equipment on the public highway, we are unable to accept private applications. Invoices are sent at the end of every month directly to the scaffolding/hoarding contractor.

The list of authorised contractors to place scaffold on the Public Highway in St Helier are as follows:

During the assembly or dismantling period, a safe working area at ground level is required to prevent pedestrians gaining access. In the town centre this work is to be carried out outside normal working hours. For example on a Sunday after 9am, or in between peak traffic (between 9:30 am and 4pm)

Road Closures (P10):

Road Closures within St Helier are frequent, due to the number of roads within the parish. Permission is needed from the Highways Authority ie the States - Transport and Technical Services for main roads, and Parish of bi-roads. Within St Helier, the Parish administer all applications.

Applications can be made by returning the application form.

From 1st February 2012, the charge for road closures will be increased to £50. This will be invoiced at the end of the month for every day or part there of the road is closed.

A minimum of 14-days notice is required in order to inform various organisations and agencies.


Embargoes:

With St Helier being the town centre of the island, there are seasonal embargoes set in various areas. A list of these is available to download .


Current Road Surfacing Projects:

The Parish is responsible for around thirty-three miles of bi-roads throughout St Helier. These tarmac surfaces can last between ten to forty years, depending on traffic usage and utility disturbances.The Parish sets a programme every financial year to resurface approximately 1.3 miles.

For the year 2011 - 2012 the following was agreed with the Parish's Roads Committee:

  • Byron Road - Between Val Plaisant and St Mark's Road - OUTSTANDING
  • Dongola Road - *** COMPLETE ***
  • Newgate Street - OUTSTANDING
  • Old St John's Road - OUTSTANDING
  • Oxford Road - Between Byron Road and entrance to Springfield Sports Ground - OUTSTANDING
  • Rue de Podetre - *** SCHEDULE WEEK BEGINING 16 APRIL***
  • South Hill - *** COMPLETE ***
  • Vallee des Vaux - Part - OUTSTANDING


Visit du Branchage:

On the Visite du Branchage, the Connétable, assisted by the members of the Roads Committee, Roads Inspectors and the Centeniers, will visit the roads of his Parish, accompanied by the Vingteniers in their respective Vingtaines, to ensure that the branchage has been completed.

Occupiers of land may be fined up to £50 for each infraction unless:
  • the 'branchage' (hedges, branches and overhanging trees) has been trimmed back so as to give a clearance of 12 feet over main roads and by-roads; and
  • the 'branchage' (hedges, branches and overhanging trees) has been trimmed back so as to give a clearance of 8 feet over footpaths; and all trimmings have been removed from the road.
If the branchage has not been completed, the occupier will be required to undertake the work and, if it is not carried out, the Parish may arrange for the work to be done and charge the occupier the cost of this work.

The Visite du Branchage applies to all public roads, including main raods, by-roads and footpaths.

2012's visits are taking place on Wed 4th July and Wed 5th September.
